Max Miller's Lawyer Admits Fault After Sharing Private Images of the Congressman's Daughter
The attorney representing Rep. Max Miller has taken full responsibility for accidentally including a sensitive image of the congressman's 2-year-old daughter in a public document release, an incident that has drawn sharp criticism from his ex-wife's legal team and renewed calls from a sitting senator for Miller to resign.
Miller posted a public Dropbox folder over the weekend alongside a video statement responding to domestic abuse allegations from his ex-wife, Emily Moreno, saying he had "nothing to hide" and would not end his reelection campaign because of her claims.
According to Moreno's attorney, the initial version of that folder included private images of the couple's daughter, with the child's name left unredacted, and at least one image that Moreno's legal team said appeared to show the child in a state of undress. In a letter to Miller's attorney, Moreno's lawyer, Subodh Chandra, wrote that the image could potentially be considered child sexual abuse material, and that the post had been viewed more than 200,000 times before a revised version of the folder removed the images.
The Attorney's Response
Miller's attorney, Aaron Minc, took sole responsibility for the oversight in a statement. "In the course of assembling and publishing a large volume of documents, I was responsible for ensuring that any sensitive information was redacted and removed from the files," Minc said. "Unfortunately, I missed the last three pages of a 40+ page document with sensitive content. It was completely unintentional and a mistake. The moment I discovered the issue on Monday morning, I corrected the file immediately. To be clear, this was completely my fault. I am solely responsible for what happened."
Minc pushed back on the characterization of the image itself, telling Mediaite, "There were no images of 'genitals.' A two-year-old girl had her shirt off. That is a deliberately false, sensationalized, and disgusting characterization."
According to CNN, the images stemmed from a February 2025 exchange between Miller and Moreno as they coordinated their child custody arrangements, after Moreno noticed a bruise on their daughter while giving her a bath and Miller asked to see a photo of the injury, which later turned out to be a broken collarbone.
The Underlying Custody Dispute
The document release came amid a broader legal battle between Miller and Moreno, the daughter of Sen. Bernie Moreno. Emily Moreno has accused her ex-husband of a pattern of physical abuse, including allegations that he threw hot water on her, held a gun to her head, and was involved in an incident that led to their daughter's collarbone fracture. Miller has denied the allegations.
Sen. Bernie Moreno, who had previously stayed relatively quiet on the matter, called on Miller to resign from Congress over the weekend following the video statement and document release. According to reporting from Raw Story, the senator reacted further to news of the accidentally shared image by calling for felony charges to be pursued.
Representatives for Rep. Miller did not immediately respond to additional requests for comment following the CNN and Mediaite reports.
