Malcolm-Jamal Warner's Widow Sues His Mother for $1.2 Million
Malcolm-Jamal Warner's widow has filed a lawsuit against the late actor's mother, alleging that Warner failed to fulfill financial promises made to her under their prenuptial agreement before his death last year.
Tenisha Warner filed the complaint July 20, one year to the day after her husband's death, in DeKalb County Superior Court in Decatur, Georgia. The suit names Pamela Warner, Malcolm-Jamal Warner's mother, as a defendant in her role as successor trustee of the Warner Family Trust. Tenisha Warner is seeking more than $1.2 million she alleges is owed to her under the terms of the couple's prenuptial agreement.
According to the complaint, Tenisha and Malcolm-Jamal Warner married on May 23, 2022, and signed the premarital agreement eight days before their wedding. The suit alleges Malcolm-Jamal Warner failed to follow through on several financial commitments outlined in that agreement, including maintaining a $1 million term life insurance policy naming Tenisha as the sole beneficiary. She also alleges he never made annual tax-free payments of $16,000 he had agreed to provide, never funded a Roth IRA on her behalf, and never paid her a promised monthly salary of $5,000 for serving as his chief of staff and assistant.
The suit claims Malcolm-Jamal Warner's estate does not currently have sufficient assets to cover the alleged debt, and asks the court to allow Tenisha Warner to recover the funds from the family trust instead. She is also seeking interest and attorney's fees, along with a court order preventing Pamela Warner from distributing any additional money or property from the trust while the case is pending.
"I Had No Choice"
Tenisha Warner addressed the lawsuit directly in a statement. "For the last year, I have attempted to privately settle my beloved husband's complicated estate and honor his last wishes," she said. "Malcolm had every intention to provide for our 9-year-old daughter and me. He was close to finalizing a new estate plan to replace the stale plan created in 1996 when he was 26 years old, 20 years before we met and well before we gave birth to our beautiful daughter. Sadly, he was unable to do so before we lost him."
She went on to describe the difficulty of the past year. "I have been struggling to care for our daughter as a single mom and now as her sole provider," she said. "Legally, I had no choice but to take action to protect our rights before any potential statute of limitations expired. We thank you for your support, love and understanding as we work through this painful process while honoring Malcolm's life on the first anniversary of his death."
Representatives for Tenisha Warner, Pamela Warner and Malcolm-Jamal Warner's estate have not yet responded to requests for comment on the lawsuit.

Malcolm-Jamal Warner, best known for playing Theo Huxtable on The Cosby Show, died on July 20, 2025, at 54, in an accidental drowning while vacationing with his family in Costa Rica. He began his decades-long acting career as a child star and continued working in television, film and music throughout his life.
